Commercial property law — Checklist of lessee for retail lease
Introductory note: | |
The process of creating a formal agreement to lease typically requires that the lessee’s solicitor obtain certain documents and instructions from the lessee.
How to use this checklist:
This checklist serves as a list of the documentation and instructions typically required of a lessee.
Other notes: | |
It is recommended that practitioners advise their lessee clients, and obtain instructions at the outset, that the lessee may not be given possession unless and until the lessee provides the instructions and documentation set out in the below checklist to the lessor’s satisfaction. This should be made clear by a letter from the lessee's solicitor to the lessee. When such instructions and documentation are given, the managing agent and the lessor's solicitor should both be informed.
