Introductory note: |
If a judgment or order has been expressed ambiguously or fails to express the court’s intentions correctly because of an accidental error or omission, it may be amended. |
If the order is sought on the basis of impropriety of one party refusing to correctly amend the register, or not recognising an agreement which was made which would affect the register, an applicant must prove those matters on the balance of probabilities. |
