Checklist of Rights and obligations relating to union rights of entry

Introductory note:
Union officials who hold a current valid permit have a right to enter your workplace for specifically defined purposes under the Fair Work Act 2009 (Cth). These may be for the purpose of:
  investigating a suspected breach of federal workplace laws;
  investigating suspected breaches relating to outworkers in the textile, clothing and footwear (TCF) industry;
  holding discussions with employees; and
  exercising rights under state/territorial work health and safety (WHS) laws, including to consult and advise relevant workers on work health and safety matters and to inquire into a suspected breach of WHS laws.
This checklist is designed to help you determine what reasonable directions you can give to a union official while they remain at your workplace.
How to use this checklist:
This checklist is intended for the use of national system employers.
This checklist provides you with an indication of what you can and can’t reasonably direct from a union official.
